米民主党、トランプ大統領の弾劾決議案を準備

トランプ米大統領の支持者たちによる議会襲撃を受けて、野党・民主党は大統領が「反乱を扇動」したとする弾劾条項を含む訴追決議案を11日にも連邦議会の下院に提出する。

民主党ペロシ下院議長は、ペンス副大統領に憲法修正25条に基づく解任を求めたが、副大統領は応じていない。

ペロシ下院議長は1月8日、トランプ大統領が直ちに辞任しないなら弾劾手続きを進めると述べた。

民主党議員の半数をはるかに超える150人の下院民主党議員が弾劾訴追決議案に署名した。

下院が弾劾の罪状について大陪審の役割を果たし、調査・起訴する。
弾劾訴追決議案を可決し、上院に送付(=起訴)する。

2019年末の 「ウクライナ疑惑」に関しての弾劾に続く2度目の弾劾となる。

この弾劾裁判では、陪審員を務める上院議員による評決を行い、与党・共和党の多数票で、無罪判決が下された。

下院が短期で弾劾決議しても、上院では出席議員の3分の2以上の賛成が必要で、ハードルは高い。

民主党は、弾劾決議が成立しても、当面、上院に決議案を送付しない可能性があるとしている。

弾劾裁判は全ての上院議員が出席するため裁判中は委員会で指名公聴会を開いたり、法案を審議したりできなくなる。
送付を遅らせる案は、バイデン政権が指名する政府高官の承認や新型コロナウイルス対策を優先する狙いがある。

共和党トップのマコネル上院院内総務もトランプ政権下で裁判を行わない方針を周辺に伝達しており、裁判はバイデン政権発足後に始まるのは確実な情勢となっている。 (1月5日のジョージア州上院議員選挙で当選した民主党の2人は、まだ就任の手続きが終わっておらず、上院は共和党が多数である。)

1月20日にトランプ氏が退任した後も弾劾裁判が続く場合、罷免ではなく「有罪」だとの判断を議会として示すことで、大統領選への再出馬を阻止することが目的になる。上院は過半数の賛成で、弾劾裁判で有罪となった人物から公職に就く資格を剝奪できる。


弾劾決議案は下記の通りで、議事堂侵入を焦点とし、大統領が暴動を扇動したと非難しているが、加えて、1月2日にジョージア州の州務長官に電話し、同州での大統領選の結果をひっくり返す票を見つけるよう伝え、脅したことなども挙げている。 (その後、一部修正した。1/12記事参照)

Resolution

Impeaching Donald John Trump, President of the United States, for high crimes and misdemeanors.

 Resolved, that Donald John Trump, President of the United States, is impeached for high crimes and misdemeanors and that the following article of impeachment be exhibited to the United States Senate:

Article of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Donald John Trump. President of the United States of America, in maintenance and support of its impeachment against him for high crimes and misdemeanors.

 Article Ⅰ:Incitement of Insurrection

 The Constitution provides that the House of Representatives "shall have the sole Power of Impeachment" and that the President "shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors". In his conduct of the office of President of the United States - and in violation of his constitutional oath faithfully to execute the office of President of the United States and, to he best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed - Donald John Trump engaged in high Crimes and Misdemeanors by willfully inciting violence against the Government of the United States, in that:

 On January 6, 2021, pursuant to the Twelfth Amendment of the United States Constitution, the Vice President of the United States, the House of Representatives, and the Senate met at the United States Capitol for a Joint Session of Congress to count the votes of the Electoral College. Shortly before the Joint Session commenced, President Trump addressed a crowd of his political supporters nearby. There, he reiterated false claims the "we won this election, and we won it by a landslide".
He also willfully made statements that encouraged - and foreseeably resulted in - imminent lawless actions at the Capitol. Incited by President trump, a mob unlawfully breached the Capitol, injured law enforcement personnel, menaced Members of Congress and the Vice President, interfered with the Joint Session's solemn constitutional duty to certify the election results, and engaged in violent, deadly, destructive, and seditions acts.

 President Trump's conduct on January 6, 2021 was consistent with his prior efforts to subvert and obstruct the certification of the results of the 2020 presidential election. Those prior efforts include, but are not limited to, a phone call on January 2, 2021, in which President Trump urged Georgia Secretary of State Brad Raffensperger to "find" enough votes to overrun the Georgia presidential election results and threatened Mr. Raffensperger if he failed to do so.

 In all of this, President Trump gravely endangered the security of the United States and its institutions of government. He threatened the integrity of the democratic system, interfered with the peaceful transition of power, and imperiled a coordinate branch of government. He thereby betrayed his trust as President, to the manifest injury of the people of the United States.

 Wherefore President Trump, by such conduct, has demonstrated that he will remain a threat to national security, democracy, and the Constitution if allowed to remain in office, and has acted in a manner grossly incompatible with self-governance and the rule of law. President Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States.
